Enactuate Pty Ltd (ABN: 55 661 545 286) values and respects the privacy of the people we deal with. This policy outlines our ongoing obligations to you in respect of how we manage your Personal Information.

We are bound by the Privacy (Market and Social Research) Code 2021, which is a ‘registered APP code’ under the Privacy Act 1988 (Cth) (the Privacy Act). APP refers to the Australian Privacy Principles, and they govern the way in which we collect, use, disclose, store, secure and dispose of your Personal Information.

What is Personal Information and why do we collect it?​
Personal Information is information or an opinion that identifies an individual. Examples of Personal Information we collect includes names, addresses, email addresses, phone and facsimile numbers.

This Personal Information is obtained in many ways including interviews, correspondence, by telephone and facsimile, by email, via our website (enactuate.com), from media and publications, from other publicly available sources, and from third parties.

We collect your Personal Information for the primary purpose of conducting research activities in accordance with this Privacy Policy. We will not use or disclose your personally identifiable information for the purpose of advertising, promotions or direct marketing activities. We may also use your Personal Information for secondary purposes closely related to the primary purpose, in circumstances where you would reasonably expect such use or disclosure – for example, for the provision of research incentives, to contact you in relation to our quality assurance processes, to comply with do-not-contact requests, and for any other purpose for which we believe there is a genuine research concern.

You typically have the option of not identifying yourself, or of using a pseudonym when dealing with us. There are certain circumstances where this will not be possible, for example, where we are required by law or through the order of a Court or Tribunal for participants to identify themselves, or where it is impracticable for us to deal with the individuals who have not identified themselves or used a pseudonym.

When we collect Personal Information we will, where appropriate and where possible, explain to you why we are collecting the information and how we plan to use it.

Sensitive Information
Sensitive information is defined in the Privacy Act to include information or opinion about such things as an individual's racial or ethnic origin, political opinions, membership of a political association, religious or philosophical beliefs, membership of a trade union or other professional body, criminal record or health information.

Sensitive information will be used by us only:
• For the primary purpose for which it was obtained
• For a secondary purpose that is directly related to the primary purpose
• With your consent; or where required or authorised by law.

Third Parties
Enactuate will typically collect your Personal Information from you via your participation in interviews or other research activities. In some circumstances we may be provided with information by third parties for the purpose of contacting you in relation to a research activity. Where this happens, we will ensure that you are made aware of the facts of this third-party provision in accordance with Privacy (Market and Social Research) Code 2021.
Disclosure of Personal Information
Your Personal Information may be disclosed in a number of circumstances including the following:
• Third parties where you consent to the use or disclosure; and
• Where required or authorised by law.
Security of Personal Information
Your Personal Information is stored in a manner that reasonably protects it from misuse and loss and from unauthorized access, modification or disclosure.

When your Personal Information is no longer needed for the research purpose for which it was obtained, we will take steps to destroy or permanently de-identify your Personal Information. In certain circumstances we may be required to retain Personal Information for a longer period, for example, where required by law, or to comply with do-not-contact requests.

During the time it is required, any Personal Information we collect will be stored at datacentres located physically within Australia. Enactuate will not transmit to, or store Personal Information outside of Australia.

Access to your Personal Information
You have the right to request access to any Personal Information we hold about you. You can request this information by contacting the Privacy Officer at the details listed below. Where we hold information that you are entitled to access, we will respond to your request in a reasonable time and endeavour to provide you with a suitable range of choices as to how access is provided (for example, emailing or mailing it to you). A fee may be charged to cover the cost of retrieval. However this fee will not be excessive and will only apply to the facilitation of your request.

If at any time you believe that Personal Information we hold about you is incorrect, incomplete or inaccurate, then you may request amendment of it and we will either amend the information or make a record of your comment, as we think appropriate.

In order to protect your Personal Information, we may require identification from you before releasing the requested information.

Maintaining the Quality of your Personal Information
It is an important to us that your Personal Information is up to date. We will take reasonable steps to make sure that your Personal Information is accurate, complete and up-to-date. If you find that the information we have is not up to date or is inaccurate, please advise us as soon as practicable so we can update our records.

Miscellaneous
In this policy “personal information” has the same meaning as under the Privacy Act.

This policy is effective from 01 January 2024. We may change this policy from time to time. Although we intend to observe this Privacy Policy at all times, it is not legally binding on Enactuate in any way. From time to time we may regard it as necessary or desirable to act outside the policy. Enactuate may do so, subject only to any other applicable contractual rights you have and any statutory rights you have under the Privacy Act or other applicable legislation.
